1. Introduction

   1. The website www.polishspecialities.com (“Website”) is owned by Polish Specialities Ltd., a company registered in England with company number 5306127 whose registered office is at Unit 5, Newman Road Industrial Estate, Croydon CR0 3JX, Surrey, our VAT number is GB 792015632.

   2. References to "we", "us", "our" and "Polish Specialities" in these terms and conditions („Terms”) are references to the Polish Specialities Ltd.

   3. Via the Website we sell food products („Products”) to you subject to the Terms listed below. We suggest you print a copy of Terms and retain them for your records.

   4. Please read Terms carefully before using the Website. By using Website, you signify your agreement to be bound by Terms. If you do not agree with these Terms, you should not use the Website.

   5. We recommend to visit our Privacy Policy at www.polishspecialities.com/privacypolicy for information about personal data that we collect from you and cookies.

2. Service availability

   1. Only resident in the United Kingdom may purchased Products on the Website.

3. Your status

   1. By placing an order on the Website, you confirm that you are:

      1. legally capable of entering into binding contracts;
      2. at least 18 year old;
      3. resident in the England.

4. Account

   1. To purchase a Products, you will need to register an account.

   2. Registration is free of charge.

   3. You must supply in the process of registration truthful, accurate and complete information.

   4. Please keep your username and password secure and don’t allow anyone to use them. Polish Specialities will not be responsible for any loss from unauthorized access to your account.

   5. You may terminate your account at anytime. Also at any time you may modify any information in your account.

   6. Polish Specialities reserves the right to suspend or terminate your account in any case of breach of these Terms or laws.

5. Formation of the contract

   1. You can purchase a Product from us by placing an order on the Website, by calling or by sending an e-mail.

   2. After placing an order you will receive an email from us acknowledging that we have received your order ("Order Acknowledgement").

   3. Order Acknowledgement does not constitute a confirmation that your order has been accepted by Polish Specialities. Your order constitutes only an offer to us to buy a Product.

   4. All orders are subject to acceptance by Polish Specialities.We reserve the right not to accept your order for any reason.

   5. No Product will be shipped to you until payment has been made in full.

   6. We will confirm acceptance of the order by sending you an e-mail that confirms that the Product has been shipped to you or that you can pick up the Product from us, if you choose this option ("Shipping Confirmation").

   7. The contract between you and us will only be formed when we send you the Shipping Confirmation ("Contract").

6. Risk and title

   1. The Product will be at your risk from the time of delivery.

   2. Ownership of the Product will pass to you when Polish Specialities will receive the full amount of payment for the Product.

7. Availability and delivery

   1. Ordered Products are subject to availability and in the event that we are unable to supply the Product, we will inform you of this as soon as possible. If you have already paid for the Product we will give you a full refund.

   2. We will deliver the Product to you by the delivery date set out in the Shipping Confirmation. Also in the Shipping Confirmation are specified delivery charges.

   3. Please note that, we deliver Products only in the United Kingdom.

   4. Product will be delivered to you by the delivery company: Polish Specialities or by us.

   5. Also you may pick up Products directly from us Unit 5, Newman Road Industrial Estate, Croydon CR0 3JX, Surrey within 24 hours from the Shipping Confirmation.

8. Price and payment

   1. The price of any Products will be as quoted on the Website in GBP.

   2. These prices include VAT, but exclude delivery cost.

   3. Prices may change at any time, but changes will not affect orders for which we have already sent a Shipping Confirmation.

   4. Payment will be accepted Pay Pal, By Bank transfer or By credit/debit card. In case of direct pick up of Products from us, you may pay by cash.

9. Your right to cancel

   1. Consumer has the right to cancel the Contract within 14 days without giving any reason.

   2. The right to cancel the Contract will expire after 14 days from the day on which you receipted the Product.

   3. To exercise the right to cancel you must inform us of your decision to cancel from Contract by statement e.g. a letter send by post: Unit 5, Newman Road Industrial Estate, Croydon CR0 3JX, Surrey, or by e-mail: orders@polishspecialities.com. You may use attached cancellation form to Terms, but it is not obligatory.

   4. After exercising the right to cancel, you must return the Products to us without any undue delay and in any event not later than 14 days from the day on which you notify your cancellation from the Contract to us. The deadline will be met if you send back the Products to us before the below period of 14 days has expired.

   5. Return the Product must be to Polish Specialities at address: Unit 5, Newman Road Industrial Estate, Croydon CR0 3JX, Surrey.

   6. Please note, that you will have to bear the direct cost of returning the Products to us.

   7. Right of cancellation does not apply in following cases:

      1. the supply of water, gas, electricity or district heating - for which the price is dependent on fluctuations in the financial market which cannot be controlled by the trader and which may occur within the cancellation period;

      2. the supply of goods that are made to the consumer’s specifications or are clearly personalized;

      3. the supply of goods which are liable to deteriorate or expire rapidly;

      4. the supply of alcoholic beverages, where: (i) their price has been agreed at the time of the conclusion of the sales contract,(ii)delivery of them can only take place after 30 days, and(iii)their value is dependent on fluctuations in the market which cannot be controlled by the trader;

      5. contracts where the consumer has specifically requested a visit from the trader for the purpose of carrying out urgent repairs or maintenance;

      6. the supply of a newspaper, periodical or magazine with the exception of subscription contracts for the supply of such publications;

      7. contracts concluded at a public auction;

      8. the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.

10. Refund policy

    1. After cancellation of the Contract we will refund all payments received from you, including the cost of delivery (with the exception of additional expenses arising from a decision by the customer to choose a delivery mode other than the least expensive ordinary delivery we offer), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel the Contract.

    2. The refund will be processed using the same means of payment that you used for the purchase, unless you have expressly agreed otherwise. You will not incur any fees as a result of such reimbursement.

    3. Polish Specialities has the right to withhold reimbursement until received the Products back or you have supplied evidence of having sent back the Products.

11. Return policy

    1. In addition to the right to cancel the Contract you can return the Product within 3 days of order date.

    2. To exercise the right to return the Product you must inform us of your decision e.g. by a letter send by post or e-mail.

    3. Product should be returned immediately to Polish Specialities at address: Unit 5, Newman Road Industrial Estate, Croydon CR0 3JX, Surrey.

    4. Shipping charges on your original shipment are not refundable.

    5. Our return policy does not affect your statutory rights.

12. Intellectual property rights

    1. Polish Specialities is the owner or the licensee of all intellectual property rights on the Website.

    2. You may not use any material on the Website for commercial purposes without our or our licensee consent. You are permitted to use material contained within this Website only for your personal non-commercial use.

13. Waiver

    1. If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.

14. Severability

    1. If any provision of these Terms are determined to be invalid, unlawful or unenforceable the remainder of these Terms shall continue to be valid and enforceable.

15. Law and jurisdiction

    1. Contracts for the purchase of the Products via the Website or any other dispute is governed by laws of English and Wales.

    2. You submit to the non-exclusive jurisdiction of the courts of England and Wales.

    3. All communications between you and us especially about the Contract for the purchase of the Products via the Website will be in English language.

16. Online dispute resolution platform 

    1. You may refer the complaint dispute to the EU’s Online Dispute Resolution Platform at http://ec.europa.eu/odr.

    2. The ODR platform is free of charge.

17. Changes

    1. We reserve the right to change these Terms at any time. Any such changes will take effect when posted on the Website.

    2. Always you will be subject to the Terms in force at the time that you order Product from Polish Specialities
